Slack fill complaint leads to empty feeling
Eric F. Greenberg, Attorney-at-Law

Consumer group the Center for Science in the Public Interest has asked the Food and Drug Adminstration and many U.S. states to suppress a problem the group’s head calls “commonplace.” It says “slack fill” in food packaging is cheating consumers.
As explained below, empty space in a package, or slack fill, is not a problem for regulators unless it is nonfunctional, and, as most packaging professionals know, there certainly are a lot of important functions that slack fill might serve.
It’s not really clear that this problem is big or getting bigger, and moreover, this is an odd time to complain about packaging being excessive.

Eric F. Greenberg P.C. - Law Firm Practicing: Food & Drug Law, Packing Law, and Commercial Litigation

Practice Areas

Chicago, Illinois, Commercial Litigation Law Firm

Eric F. Greenberg, P.C. provides legal representation to clients whose food products are, or are suspected of being in violation of FDA provisions and state laws. He has represented numerous parties experiencing hardships and helped them comply with FDA regulations. Any food crisis affects many suppliers, even suppliers whose food is not contaminated.

For example, when the spinach outbreak hit the United States, a number of companies responsible for producing and transporting spinach were affected when it was temporarily removed from the market. It was a preventative measure to reassure consumers that quality assurance guidelines would be assessed and new practices would be put into place.

Representing Companies before the FDA & State Agencies

For 20 years, Mr. Greenberg has handled crisis management for companies throughout Illinois and the United States. Large corporations and production plants count on legal representation when a food poisoning outbreak or contamination, production, packaging, or shipping issue emerges. When such crises arise, we can help clients in the following ways:

  • Assist with determining recall of the product.
  • Handling communications with the Food and Drug Administration and state agencies.
  • Coordinating statements for presentation to consumers and the media.
  • Establishing new practices and procedures for protection of consumers.
  • Investigation of the scope and cause of the crisis/outbreak/contamination.
  • Limiting damage caused by food crisis.
  • Reassuring and preserving customer relations.

When a company responds proactively and effectively, reassuring clients, and putting into practice new safety procedures, the company can often come out of the crisis in a better position and stronger than when it started. Responding successfully to a crisis in the food industry is the most important step in resolving it. In turn, effective preparation is a key to a successful response.
